    Terms of Service

    1. Acceptance of Terms

    By creating an account, accessing, or using ParentLevel (the "Service" or "App"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must not use the Service.

    These Terms constitute a legally binding agreement between you and ParentLevel. For material changes to these Terms, we will notify you in advance and, where required by applicable law, seek your explicit agreement before the changes take effect.

    2. Eligibility

    You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to create an account and use the Service. By using ParentLevel, you represent and warrant that:

    • You meet the minimum age requirement;
    • You have the legal capacity to enter into a binding contract;
    • You are not barred from using the Service under any applicable law; and
    • The information you provide during registration is accurate and complete.

    ParentLevel is designed exclusively for adults — parents, guardians, and caregivers — and is not intended for use by children under 18.

    3. Description of the Service

    ParentLevel is a gamified personal-development platform for parents. It helps parents build intentional parenting habits through structured challenges, progress tracking, and social accountability features, including:

    • Daily, weekly, and seasonal parenting challenges personalized to your child's age and developmental stage;
    • An experience points (XP), level, and achievement system to recognize consistent effort;
    • Streak tracking and emotional check-in tools for self-reflection;
    • Partner and friend challenges to strengthen co-parenting and family bonds;
    • Community leaderboards for friendly competition among parents.

    Important: ParentLevel is a motivational tool and a personal-development aid. It does not provide medical, psychological, therapeutic, clinical, or professional parenting advice of any kind. Nothing in the App should be construed as a substitute for professional guidance. Always consult qualified professionals for concerns about your child's physical, emotional, or developmental well-being.

    4. User Accounts & Security

    You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

    • Provide truthful, accurate, and current information during registration and keep it updated;
    • Protect your login credentials and not share them with any third party;
    • Notify us immediately at parentlevel@gmail.com if you suspect any unauthorized access or security breach; and
    • Accept full responsibility for all actions taken under your account, whether authorized by you or not.

    We may suspend or disable your account if we believe you have violated these Terms or if your account poses a security risk, with at least 7 days' written notice where circumstances permit. In the case of serious violations, fraud, or imminent security threats, we may act immediately without prior notice.

    5. Acceptable Use

    You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You expressly agree not to:

    • Use the Service for any illegal purpose or in violation of any local, state, national, or international law or regulation;
    • Attempt to gain unauthorized access to any part of the Service, its infrastructure, or other users' accounts;
    • Interfere with, disrupt, or damage the Service or its servers;
    • Circumvent, disable, or otherwise interfere with security-related features;
    • Use automated tools, bots, scrapers, or scripts to access the Service;
    • Reverse-engineer, decompile, or disassemble any part of the Service;
    • Submit false, misleading, or fraudulent information;
    • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
    • Exploit or manipulate the gamification system through fraudulent means; or
    • Use the Service to transmit unsolicited commercial messages or spam.

    Violation of this section may result in immediate termination of your account without refund.

    6. Subscription, Billing & Refunds

    ParentLevel offers both a free tier and paid subscription plans. By subscribing to a paid plan, you agree to the following:

    • Fees: Subscription fees are stated at the time of purchase and are charged in advance on a recurring basis (monthly or annually, depending on your selected plan).
    • Automatic renewal: Your subscription automatically renews at the end of each billing cycle unless you cancel before the renewal date. For annual plans, we will send you a renewal reminder at least 7 days before your billing date.
    • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until that date.
    • Refunds: Brazilian users may cancel and receive a full refund within 7 calendar days of the start of their subscription, per CDC Art. 49. EU users may cancel within 14 days of subscription start, per Directive 2011/83/EU. Outside these statutory windows, fees are non-refundable unless required by applicable law. To request a refund, contact us.
    • Price changes: We reserve the right to change subscription prices, with at least 30 days' advance written notice of any increase. Continued use of the Service after the new price takes effect constitutes acceptance of the new pricing, to the extent permitted by applicable law. This 30-day notice requirement takes precedence over any shorter notice period provided elsewhere in these Terms.
    • Taxes: Prices may be exclusive of applicable taxes, which will be added where required by law.
    • Failed payments: If a payment fails, we may downgrade your account to the free tier and suspend access to premium features until payment is resolved.

    7. Intellectual Property

    All content, features, and functionality of the Service — including but not limited to text, challenges, challenge mechanics, design, graphics, icons, code, audio, and trade dress — are the exclusive property of ParentLevel and are protected by applicable copyright, trademark, patent, and other intellectual property laws.

    Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service solely for your own personal, non-commercial purposes. You may not copy, modify, distribute, sell, sublicense, or create derivative works based on any part of the Service without our prior written permission.

    8. User-Provided Content

    Certain features allow you to submit content, including profile information, children's names and ages, and emotional check-in responses ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant ParentLevel a worldwide, royalty-free, non-exclusive license to use, store, process, and display that content solely for the purpose of operating, maintaining, and improving the Service.

    You represent and warrant that your User Content does not violate any applicable law, infringe any third-party rights, or contain any harmful, defamatory, or unlawful material. You are solely responsible for the accuracy and appropriateness of your User Content.

    9. Disclaimer of Warranties

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION.

    We do not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be available at all times or at any particular time; (c) any content or information provided through the Service is accurate, complete, or reliable; or (d) any defects or errors will be corrected.

    No oral or written information or advice provided by ParentLevel or its representatives shall create any warranty not expressly stated in these Terms. Brazilian consumers retain statutory warranty rights (garantia de adequação) under the Código de Defesa do Consumidor that are not waived by this section.

    10. Limitation of Liability

    TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

    • ParentLevel, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, or personal injury, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
    • Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Service shall not exceed the total amount you paid for the Service in the twelve (12) months immediately preceding the event giving rise to the claim. These limitations do not apply to liability for death, personal injury, fraud, or as otherwise prohibited by applicable law.
    • The limitations above apply regardless of the legal theory on which the claim is based, including contract, tort, strict liability, or any other theory.

    Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

    11. Indemnification

    You agree to defend, indemnify, and hold harmless ParentLevel and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way related to:

    • Your access to or use of the Service;
    • Your violation of these Terms;
    • Your User Content; or
    • Your violation of any applicable law or third-party right.

    12. Force Majeure

    ParentLevel shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet outages, infrastructure failures, cyberattacks, or government actions.

    13. Termination

    We may suspend or permanently terminate your access to the Service if we determine that you have violated these Terms, posed a security risk, or engaged in conduct harmful to other users or to the Service. We will endeavor to provide at least 7 days' prior written notice, except in cases of serious violations, fraud, or imminent security threats, where we may act immediately. If we terminate your account for reasons other than your violation of these Terms, we will refund a pro-rated amount for any unused portion of your prepaid subscription.

    You may terminate your account at any time by using the account deletion feature within the App or by contacting us. Upon termination, your license to use the Service ceases immediately. Provisions that by their nature should survive termination — including but not limited to Sections 7 (Intellectual Property), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), and 14 (Governing Law) — shall survive.

    14. Governing Law & Dispute Resolution

    These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Brazil, without regard to conflict-of-law rules. Notwithstanding the above, if you are a consumer in the European Union, the mandatory consumer protection laws of your country of residence apply and are not displaced by this choice of law.

    Informal resolution: Before initiating any formal proceeding, you agree to contact us at parentlevel@gmail.com and attempt to resolve the dispute in good faith. Most concerns can be resolved this way.

    Arbitration: If informal resolution fails, any dispute shall be finally settled by binding arbitration under the rules of the Câmara de Mediação e Arbitragem Empresarial Brasil (CAMARB), with proceedings conducted in Portuguese in São Paulo, Brazil. The arbitration award shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

    Class action waiver: To the fullest extent permitted by applicable law in your jurisdiction, you waive your right to participate in a class action or class-wide arbitration. This waiver does not apply to users located in the European Union or Brazil, where collective redress rights cannot be waived by contract.

    Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

    15. General Provisions

    • Entire agreement: These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and ParentLevel and supersede all prior agreements or understandings.
    • Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
    • No waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
    • Assignment: You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms freely in connection with a merger, acquisition, or sale of assets.
    • Notices: We may provide notices through the App, by email, or by posting updated terms on our website. You are responsible for keeping your contact information current.

    16. Changes to These Terms

    We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days' notice through the App or by email and, where required by applicable law, seek your explicit agreement before the changes take effect. Price changes are always subject to the 30-day notice requirement in Section 6, which this section does not override. If you do not agree to a material change, you may terminate your account before the change takes effect.
